Adaptive terms of use

Using Adaptive
Adaptive writes you a training program and keeps a record of what you did. Writing programs is free. Training Intelligence is the part of Adaptive that writes and changes programs, and it is also the name of the subscription described under "Training Intelligence, the subscription" below. You need an Apple Account to sign in, and you have to be 13 or older.
Adaptive is not medical advice
Adaptive is a training app. It is not a doctor, a physiotherapist or any other kind of clinician, and nothing it says is a diagnosis, a treatment or medical advice. The programs Training Intelligence writes come from a model, reviewed against a knowledge base, and no human checks any individual program before you see it.
You decide whether a session is safe for you. If something hurts, stop. If you are not sure whether you should be training at all, ask somebody qualified before you start, and especially before you start something new.
When you tell Training Intelligence about a symptom, one of two things happens. For anything that could be cardiac, neurological or otherwise urgent, Training Intelligence refuses to write or change a program and tells you to see a medical professional. For an injury it can reasonably work around, it writes a program around the area and tells you to get it looked at first. Neither of those is a clinical judgment about you. The first is not a diagnosis, and the second is not a clearance to train. In both cases Adaptive cannot take responsibility for an injury getting worse.
Training Intelligence does not know everything about you. It knows what you told it. If something has changed, tell it, and if something matters, tell a clinician rather than an app.
What you put in it
What you write stays yours. You give us permission to store it, to show it to the friends you chose to share it with, and to send it to Training Intelligence so a program can be written. That is the whole of it.
Do not post anything about another person that you would not want posted about you. There is no tolerance for harassment or threats. Every card and every comment can be reported and every person can be blocked, from anywhere their name appears. Reports are read by a person. An account that is used to harass somebody can be removed without notice.
Your friends
A friendship is an agreement between two people and either of them can end it. Blocking somebody ends the friendship, takes their name and their words off your training, keeps them from finding you and does not tell them. You can turn off being findable by name entirely in Settings.
Your account
You can export everything and you can delete everything, both from Settings. Deleting deletes; it does not deactivate.
We can suspend or remove an account that is being used to abuse somebody else, or to attack the service.
Training Intelligence, the subscription
What stays free. Writing programs is free, the first one and every one after it. So are your program, Today, starting and ending sessions, recording every session, Settings, export, deleting your account, and every way to remove, report or block somebody. None of these needs the subscription, now or later.
What it adds. Training Intelligence is an auto-renewable subscription. With it, Training Intelligence also runs your program with you after it is written: it changes your program as you train and answers when you say how you feel. It also covers Friends, marks, charts, history, body, and connecting a wearable.
Plans and price. Monthly or yearly, sold and billed by Apple through the App Store. The price in your currency is shown in the app and on Apple's payment sheet before you confirm, and that is the price you are charged.
The free month. If your Apple Account has not had Training Intelligence before, the first month is free. You start it yourself, with one tap, and nothing starts on its own. The app shows the day it ends before you start. Unless you cancel at least 24 hours before that day, it becomes the plan you chose and your Apple Account is charged that plan's price when the free month ends. One free month per Apple Account.
Renewal. Payment is charged to your Apple Account when you confirm the purchase or, with the free month, when the free month ends. The subscription renews automatically for the same length, at the price at the time, unless auto-renew is turned off at least 24 hours before the end of the current period. Your Apple Account is charged for the renewal within the 24 hours before the period ends.
Price changes. If the price changes, Apple tells you before the new price applies to you. Where Apple or the law needs your agreement to a higher price and you do not give it, the subscription ends at the end of the period you have already paid for.
Cancelling. On your iPhone, open Settings, tap your name, then Subscriptions. Or in Adaptive: Settings, then Subscription under Training Intelligence, then Manage in the App Store. Cancelling stops the next renewal, and Training Intelligence stays on until the end of the period you have paid for. Deleting your Adaptive account does not cancel the subscription. Apple bills it, so cancel it there first.
Refunds. Apple takes every payment and handles every refund, under its own policies. You can ask Apple for one at reportaproblem.apple.com. We never see your card or bank details and cannot issue refunds ourselves. If Apple refunds a payment, Training Intelligence ends for the period that payment covered.
One account at a time. A subscription belongs to the Apple Account that bought it, and gives Training Intelligence to one Adaptive account at a time: the one it was last bought or restored on. Family Sharing does not apply to it.
When it ends. Your program, Today and every session carry on as they are, and writing programs stays free. Nothing you recorded is deleted, and changes already made to your program stay made. Changes as you train, answers to your notes, Friends, marks and charts stop until you subscribe again.
Apple's terms. Adaptive is licensed to you under Apple's Licensed Application End User License Agreement, and these terms apply alongside it.
What we promise, and what we do not
Adaptive is provided as it is. We work hard to keep it running and to keep your training safe, and we do not promise it will never be unavailable, never lose anything, or produce a program that suits you.
To the extent the law allows, we are not liable for injury, loss or damage arising from training you chose to do, or from the app being unavailable. Nothing here limits any liability that cannot be limited by law, and your statutory rights are unaffected.
Changes
If these change in a way that matters, we will say so in the app rather than only here.
